DSP Files Suit Against CSPC Over Amoxicillin Patent

DSM Sinochem Pharmaceuticals (DSP), a Singapore-headquartered producer of antibiotics, has filed a lawsuit for patent infringement of its penicillin antibiotic, amoxicillin, against Hebei, China-headquartered CSPC Pharmaceutical Group, its subsidiary CSPC Zhangnuo Pharmaceutical (Shijiazhuang) Company, and Inner Mongolia Changsheng Pharmaceutical Company for patent infringement.

DSP filed the lawsuit in a district court in the Netherlands. The patent describes amoxicillin trihydrate as having a low free-water content and processes for the manufacture thereof. By its complaint, DSP seeks compensation for damages and a permanent injunction to prevent infringing manufacture, use, importation, and sale of CSPC’s amoxicillin active pharmaceutical ingredient, and/or any drug product that uses the active pharmaceutical, in the Netherlands.
